Update on Recovery of FirstPort Expenses

We have had no response from Bloor recently in respect to the recovery of costs we have incurred from FirstPort. We assume others are in the same boat. We would expect we will soon receive the annual charge from FirstPort – it’s normally early Feb (if we recall correctly), since the “year” runs from start of Feb to end Jan.

So to warm things up, we have sent Bloor an email requesting a comprehensive response and confirmation that they will repay the costs we have incurred by next Thu (19th Jan). We have also told them that if they don’t do that, then we will issue them a Letter Before Action on Fri 20th Jan with the intention of starting legal proceedings on Fri 27th Jan.

Couple of things worth pointing out:

1. Bloor has been sat on this for too long. The more time they have, the more likely they will be able to build some sort of legal defence.
2. Bloor do not want this to end up in any legal defeat – it will have implications on all other developments that involve a Management Company.
3. For the amount of money involved (for us it’s just £8.15), Bloor is likely to just pay it. It’s not worth them going to the small claims court to defend it.
4. Our strength (in this instance) is acting individually, since it is a lot more cost effective for Bloor to defend against one party representing 140 households, compared to having to defend against 140 parties each representing 1 household.

Bloor’s Head of Customer Care has already responded to our email acknowledging the timetable we have set out, so should be interesting to see whether Bloor attempt to respond to us by next Thu!
