We have just received an email from the Deputy MD of Bloor Homes South Midlands. It relates to our request for a generic Deed of Variation to avoid mortgage challenges for residents in the future. Ultimately the response is disappointing (but unsurprising), but there are lots of entertaining elements in there as well. I’ve included it below in full:

Good Afternoon,

Thank you for allowing me the time to investigate concerns which you have raised in respect of the Management Company at our former development in Drayton, Oxfordshire.

If we could we would like to clarify our position regarding FirstPort and their continued involvement within the scheme as we approach the final stages of the maintenance period for the areas of public open space which our Adoptions Manager now expects to conclude in the Spring of 2023. Upon conclusion it is also our intention to complete the legal transfer at the Dovecote which will also allow residents to stand as directors and in effect control the continued appointment of FirstPort or indeed appoint an alternative Management Company for the development should they so choose.

We have reviewed our position regarding your request to provide a generic Deed of Variation and regret that we do not agree that this course of action is appropriate in this case, however the timely conclusion of the transfer referred to above will of course negate any concerns you may have.

Kind regards,

Deputy Managing Director

I’ll post my response in a moment. I’m sure you will have already picked up on some of the entertaining elements in the Deputy MD’s response.
