As a result of the overwhelming support for calling an urgent EGM, TDRA has submitted the requirement for Directors of the Management Company to call an EGM.
For clarity, all homeowners are referred to as Members in the context of the Management Company.
Latest updates:
- Fri 01/12/2023 – this request was issued via registered letter.
- Mon 04/12/2023 – this letter was delivered and signed for by the Company Secretary.
- Tue 05/12/2023 – the Company Secretary acknowledged the request by email. As part of that acknowledgement, evidence was requested from Members in support of the call for the EGM.
- In response TDRA advised that email votes could be viewed on site at The Dovecote.
- Fri 08/12/2023 – the Company Secretary emailed reaffirming the need for evidence to be provided in support of the call for an EGM. Without this, the requirement to call an EGM cannot be validated.
- In response, TDRA has been forced to supply a summarised list of votes, together with a zip file of the emails submitted.
- In addition, TDRA has explicitly stated that this data must be protected under the UK Data Protection Act 2018, must NOT be copied and members must NOT be explicitly contacted, other than via a generic letter to ALL members.
The Company Secretary has until Christmas Day (21 days after receipt of the requirement) to issue a notice to Members advising as to when and where the EGM will take place. If this is not satisfied, TDRA will organise an EGM on behalf of residents.
As you might imagine, this is already a bit of a struggle with the Company Secretary and no doubt, the closer we get to the date that the notice about the EGM needs to be issued, the more difficult it will get. The Company Secretary will continue to challenge everything and will push back on anything that TDRA is requesting. But we press on and we will do our best to secure the EGM that we need.
TDRA will keep this news item updated with progress.
